1. Acceptance of Terms
By accessing our website and using our services, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree with any part of these terms, please refrain from using our website and services.
 

2. Description of Services
Digital Surfing provides customized digital solutions to help businesses grow online. Our offerings include:

• Tailored Digital Expertise

• Creation of Engaging Content

• Social Media Management

We develop personalized strategies that combine creativity with data insights to boost brand visibility and meet each client’s unique goals.
 

3. Contract Agreement
A signed contract or quote is required before any work begins. This document outlines the services requested, delivery timelines, pricing, and payment terms. No work will commence without the client’s written approval, either via physical or electronic signature.
 

4. Payment Terms
Payments are made in two installments:

• A 50% deposit upon signing the contract to secure project scheduling and resources.

• The remaining 50% is due upon final delivery of the agreed-upon content.

Full payment grants the client a limited license to use the content strictly as specified in the contract (e.g., website, organic social media posts, internal presentations).
 

⚠️ Use of Content for Advertising (e.g., sponsored posts, paid campaigns, billboards):
If the client intends to use the content for advertising or promotional purposes, they must:

• Either pay a monthly licensing fee for extended advertising use,

• Or acquire full ownership rights (photos, videos, designs) for unlimited use across all platforms, formats, and durations. This fee is calculated based on the planned distribution scope, including number of channels, geographic reach, and campaign duration.
   

5. Intellectual Property
All content created by Digital Surfing (including visuals, videos, texts, concepts, etc.) remains the exclusive property of the agency until full payment is received. Upon payment, the client is granted a limited license to use the content solely for the purposes outlined in the project. Full transfer of rights—including distribution, adaptation, modification, and commercial exploitation—may be arranged upon request and subject to additional monthly fees. Any use beyond the agreed scope requires prior written authorization.
 

6. Image and Model Rights
Digital Surfing works with models during content production. By default, their images may appear across various projects such as portfolios, social media, and marketing campaigns. If a client requires exclusivity over a model’s image—meaning the model’s face will not appear in other brands’ materials—this can be secured through an “exclusive model portfolio” option, billed as an additional fee. This exclusivity must be requested before the shoot and contractually confirmed.
 

7. Confidentiality
We are committed to maintaining the confidentiality of all client information. No data will be shared with third parties without explicit written consent, except when required by law.
 

8. Liability
Digital Surfing strives to deliver high-quality services. However, the agency cannot be held liable for any indirect damages resulting from the use of deliverables, including but not limited to loss of revenue, misinterpretation of messages, or misuse on social media. The client assumes full responsibility for how the delivered content is used.
 

9. Client Conduct
The client agrees to:

• Comply with all applicable laws and regulations

• Provide accurate and up-to-date information

• Refrain from using our services for illegal, hateful, or discriminatory purposes

Digital Surfing reserves the right to refuse or terminate services in cases of abusive or non-compliant behavior.

10. Modification of Services
Digital Surfing reserves the right to modify its service offerings at any time. Any changes impacting an ongoing project will require prior written agreement with the client.
 

11. Duration and Termination
The duration of the service is specified in the contract.
In the event of early termination by the client:

• The initial deposit is non-refundable and remains with the agency.

• Depending on the progress made, the client may be liable for additional fees to cover work already completed.
